Details: 161. Robert Albert, bullock driver in the service of William Ogilvie, charged with insolence to his master and ill-treating his bullocks. Mr. Ogilvie states....from the moment I left this place to proceed to my farm beyond Patrick Plains, the prisoner became very troublesome making use of language too gross to be repeated. On my arrival on my land he continued his improper conduct and language and has also injured one of my bullocks most severely by blows on the head. By his misconduct and that of his fellow servant John Atwell, I have missed getting in a considerable quantity of seed for my next years supply. Prisoner states he did not like to leave Newcastle. Sentenced to 50 lashes and sent to the gaol gang for the remainder of his sentence

Details: William Smith per Grenada, in the service of government charged with theft at Messrs Powditch and Bouchers store. The warehouse man at Messrs Powditch & Co states ....Last night a man came to the shop and asked for an ounce of tobacco. I was engaged with some other customers at the time. He called in another man and they ran off with two iron pots. I cannot swear the prisoner is one of the men..... John Large, a constable states...I was near Messrs Powditch s house last night. There was an alarm given and I proceeded to search the neighbourhood. On the opposite side of the street, in the water course, I heard something like iron rattle, I went there and discovered the prisoner who had that evening absconded from the gaol gang. The warehouse man saw him in my custody and immediately recognised him as the man who had purchased the 1/2 ounce of tobacco. Charles Merriott, a constable states, I was present when the prisoner was taken into custody - two iron pots were found near him, they were claimed by Mr. Boucher. William Ogilvie states....I was at Messrs Powditch and Co shop last night on business. I recollect the prisoner coming there and asking for 1/2 ounce of tobacco. He called another man in and they picked up each an iron pot and ran off. The prisoner in his defence states, I got drunk in the course of the afternoon and went into the gully and fell asleep. I was found in that situation by the constable. I know nothing of the pots; I was never in Mr. Bouchers shop. William Smith Sentenced to 50 lashes

Details: Thomas Corcoran in the service of William Ogilvie, charged with disobedience of orders and quitting work without leave. Mr. Ogilvie by letter states - the prisoner was employed on some garden ground, myself and son were also at work on it. A slight shower of rain came on upon which the prisoner left off work and went into his hut and when called on to proceed in his work, refused, excusing himself by saying the rain would injure his health. The rain was so slight that neither myself or son considered it necessary to quit our employment. The prisoner in his defence states....that if he had got wet from the rain he should have suffered in his health. Sentenced to 4 days solitary confinement and afterwards to work in the gaol gang

Details: Peter Ryan, in government service, charged with theft... William Ogilvie states...some months since I was permitted to lodge some casks containing various articles in the Commissariat stores of which the prisoner is cooper. I had occasion to open one of the casks containing ironmongery shortly after and employed the prisoner whilst he was at work. I heard a jingling noise and looking down I discovered some tin cans. I thought they might have fallen out accidentally and therefore had them returned. I did not miss anything at the time. The candlestick now before the court is mine, it was in the cask that I had opened. Mr. Ogilvie having given this evidence withdrew. James Hewson states...I purchased the candlesticks now before the court some time since from Peter Ryan. I gave him a half pint of rum. It was very rusty when I bought it. Ryan had another like it in his possession. Thomas Liddell states. - I was present when Ryan sold the candlestick to Hewson. He had two with him. The prisoner states - I found the candlesticks in the store covered with rust. I did not think them of any value. I was permitted to take them by the storekeeper. Peter Ryan sentenced to 3 years to a penal settlement

Details: Mary Cottam, in service of government, charged with having stolen property in her possession. William Ogilvie states - some months since I had some irons stolen from a cask in a boat (laundresses irons). I think those before the court are mine. They are very like those I lost. Mary Cottam states she bought them from Charles Satchwell. Charles Satchwell states...about 12 months ago I bought irons in Sydney for Mary Cottam, but they are not those now before the court. Mary Cottam states - I bought the irons before the court from William Rouse and calls Hymy Franks who states - about 6 months ago I saw Rouse take a pair of irons to Cottams house. I cannot say what sort they were. I think he offered them for sale but I did not take much notice of the transaction. Edward Cottam states - my wife told me she had bought the irons ..(illegible). Ann Jackson states - I have frequently borrowed those irons from Mary Cottam. She never objected to lend them. Mary Cottam sentenced to the Factory at Parramatta for twelve months in the second class

Details: Information has just reached us, that the Aboriginal Natives have lately become very troublesome in the district of Patrick Plains. About a fortnight ago a party of them plundered the Huts of Mr. George Forbes and Captain John Pike, and speared a government servant of the former, wounding him in the back. This man is recovering. The resident Magistrate William Ogilvie proceeded in company with a friendly native in quest of the hostile tribe, and succeeded in obtaining a conference with them, and prevailed on them after a time, to restore a considerable part of some property which they had stolen
