Michael Monaghan was indicted for the wilful murder of Robert Archer at Glendon on 2 August 1838. The deceased was the prisoner s overseer. They quarrelled about some sheep getting intermixed in two different flocks and the prisoner beat the deceased so cruelly with a stick that he died. Then, with the assistance of a fellow servant named North who sat behind the dead man and held him up on his horse until they came to a solitary creek, burned his body. The jury found the prisoner guilty and the Court passed upon him the sentence of death
