John Deaton indicted for having committed an assault on James Levick, a constable whilst in discharge of his duty; a second count charged the prisoner with common assault. Constable Levick had arrested Deaton after a fight in Hunter Street, when on the way to the lock up Deaton bit the finger and thumb and right arm of the constable and pulled his hair. The wounds were very severe - bleeding freely, and were more torn than bitten and needed attendance of a doctor for a week afterwards. Witnesses for the Crown were Robert Corbet Knaggs, Edwin Henry Lake and James Baxter. Witnesses for the defence William T. Smith, William Ahern, Henry Morris, James Huntsdale and Alfred Griffiths, Letitia Tortoni; Accused was said to be a very quiet well behaved man and it was because of the ill usage he received from the policeman that he assaulted the constable. He was found not guilty on both charges and discharged
