James Power, free by servitude and Thomas Dutton, free by servitude, charged with receiving stolen property. Charles Halkin, lockup keeper deposed - The silver watch and chain now produced were taken from the prisoner Power while in a state of intoxication having him brought for confinement on that charge. He made every exertions to prevent it being taken from him. I was forced to throw him down in the lockup in order to search him. He kept his arm on the pocket in which it was evidently secreted. The watch was claimed the following morning by the prisoner Thomas Dutton. He said he brought the watch with him from England. I am aware Powers having been taken up on suspicion of being concerned in a robbery on Dr. Thomson which took place some months since above Invermein. Amongst the articles stolen from Dr. Thomson was a silver guard chain which resembles the one now produced. There was a man Robinson taken up on suspicion of being concerned in the same robbery who has since been committed on a charge of sheep stealing. John Wilmot a watchmaker by trade, assigned servant of the late Col. Dumaresq gave evidence that he had sold the silver chain to Dutton.George Linton, free by servitude, gave evidence. James Young, overseer to Mr. William Cox gave evidence...I reside on the Waybong about fifteen miles from Muswellbrook. During my absence from my hut, the door was opened and my watch and other articles were stolen....The prisoners were committed for trial
