The next prisoner placed at the bar was Sylvester Thornton. He had been convicted at the last Spring Assizes of having set fire to a rope loft, and other premises belonging to a gentleman at Liverpool, in whose employ he had been......the prisoner, when taken into custody, had, after a little time, made a confession of his guilt to the officer, without any threat or promise; but Mr. Justice Bayley reserved the case for the opinion of the judges, to state whether the peculiar circumstances under which the confession was made, did not render it tantamount to an extorted confession. Mr. Justice Bayley then addressed the prisoner, who wept, or pretended to weep, for having witnessed his conduct on his trial we did not think his sorrow sincere. In case of this description his Lordship said, where the commission of crime was so easy, and the detection so difficult it was almost out of the power of the Judge to recommend the prisoner to the Royal mercy. The offence in this instance, betrayed such dark malignity, that the difficulty of recommending the prisoner was increased. The prisoner had been kindly recommended to mercy by the prosecutor; his life should be spared; and the judge hoped he would in future abstain from crime and try to retrieve his early errors. Sentence of death would be recorded against him but it would be his lordship's duty to see that he had not again, in England at least, an opportunity of committing a similar offence.
