Supreme Court - Sparke v. Weller. This case came on for argument on a demurer to a bill filed by the plaintiff under the following circumstances - A woman named Catherine Sheridan was possessed of about fifty acres of land at Maitland, nine acres of which she sold in October 1827 to Mr. Timothy Nowlan. who took possession of it, but it being subsequently discovered that the conveyance was informal, a fresh conveyance was drawn up, and executed, on the 8th August 1830, and in the consideration of 180 pounds, Nowlan sold the land to Mr. Sparke. In May 1830, Sheridan sold the whole fifty acres to one James Connolly, without taking notice of her having sold a portion of it to Nowlan. On Sept. 3rd 1830 Connolly mortaged the land to Mr. Weller for 150 pounds giving him a warrant of attorney to sell the land in the mortgage was not redeemed by a certain day. Default having been made, judgment was entered on a certain day and a levy was made by the plaintiff on that portion of the land which was then in possession of Catherine Sheridan - who, notwithstanding the sale to Connolly still remained in possession. The land, was purchased by Weller, the mortgagee for 160 pounds. Sheridan not giving up possession, an action was commenced against her and she was ejected in 1832. Nothing was said to Mr. sparke who remained in possession of the nine acres, until 1834, when Weller put in a claim before the Commissioners for the whole fifty acres and was opposed by Mr. Sparke..........The Court declined giving any decision until the following Friday
