Details: James Buckley per ship Regalia, in the service of Mr. James McClymont, charged with theft. James McClymont states - yesterday evening whilst my family were at tea, the prisoner went out for the purpose of procuring some water from the well he passed out at the front door through the shop. I had been in the shop three or four minutes before and had looked into the till in which were silver coins of different denominations amounting to about thirty five shillings. Hearing someone at the door shortly after I went out to the shop and saw the till open and emptied, of its contents, I am persuaded no other person had been in the shop but the prisoner from the time I saw the money in the till to the time I missed it. I am confident it was he that took the money. The person who came to the door could not have had time to open the till for I was in the shop as soon as they. My suspicions immediately attached to the prisoner, I went forthwith to the well but he was not there, neither did I see him going or returning. The bucket with water was brought to the house by a stranger whilst I was absent in search of the prisoner. Question by the prisoner - Did you see me take the money - Answer - No. James Buckley remanded for further hearing the following day.....11 october 1826...The Bench are of opinion there is not sufficient evidence to convict the prisoner and he is discharged
